Individuals cannot “opt out” of the union contract once a union has been voted in.
The United Auto Workers collects dues from its members. For example, and as shown in the impact table below, the United Auto Workers touted 3.5% increases for NYU faculty, but 1.44% of their salaries will now go to union dues.
Two Possible Paths, Same Possible Outcome
Based on the NYU contract, those in union‑represented roles may be able to:
Unions often negotiate “union security” clauses that require all employees in a bargaining unit to become union members and pay union dues. These clauses, like the one the United Auto Workers negotiated in the graduate student workers agreement, sometimes permit an individual to choose not to become a union member.
BUT these clauses often require you to pay “agency fees,” which are typically equivalent to union dues. The union contract still applies to those who opt out AND the union is still required to represent all employees, even those who “opt out.”
